I asked GROK AI, As a Uk citizen, will I be able to legally refuse Digital ID

This was the reply:

As of September 26, 2025, the UK government under Prime Minister Keir Starmer has announced plans for a new digital ID scheme, often referred to as the "Brit Card." This builds on the Data (Use and Access) Act, which received Royal Assent in June 2025 and establishes a framework for trusted digital identity services. The system is designed to be stored on smartphones via a GOV.UK Wallet app and will serve as a secure way to verify identity, residency status, and right to work. It aims to curb illegal migration by making it harder for undocumented individuals to secure employment, while also simplifying access to services like welfare, driving licenses, and tax records.
The scheme is not yet fully implemented—a public consultation is planned later in 2025, with rollout expected by mid-2029 at the latest. It will be free to obtain and available to all UK citizens, legal residents, visa holders, and those with settled status.

Is It Mandatory?

• For employment: Yes, it will be mandatory for anyone seeking to work in the UK. Employers must verify right-to-work status using the digital ID, replacing less secure methods like National Insurance numbers or paper documents. This means you cannot legally start a job without it.
• For other purposes: No, it is optional for non-workers, such as students, pensioners, or the unemployed. The government has emphasized that individuals will not be required to carry or produce the ID in public spaces, and it won't be needed for everyday activities like voting or accessing healthcare (though it may streamline these in the future).
• Issuance: All eligible adults will be issued one by default to ensure universal access, but Culture Secretary Lisa Nandy has stated it's "entirely their choice" whether to use it.
This positions the system as "mandatory for the right to work" but not a universal compulsion like wartime ID cards (which the UK last used in the 1950s).

Can You Legally Refuse It as a UK Citizen?

As a UK citizen, you have the legal right to refuse to obtain or use the digital ID, but with important caveats tied to practical consequences:
• No criminal penalty for refusal alone: There is no law making possession of the ID a criminal offense. Civil liberties groups like Big Brother Watch and the Open Rights Group have campaigned for (and currently hold) a "right to use non-digital ID," arguing that forcing digital-only verification would violate privacy under the Human Rights Act 1998 (Article 8: right to respect for private life) and the UK GDPR. The government's announcement aligns with this by not mandating it beyond employment checks.
• Consequences for refusal:
• Employment: If you refuse, you cannot legally prove your right to work, effectively barring you from formal employment. Employers face fines for non-compliance, so they will insist on it. This could limit job opportunities, especially in sectors requiring verification (e.g., finance, hospitality).
• Other services: Refusal won't block access to most public services initially, but future expansions (e.g., for renting or benefits) could create indirect pressure. Vulnerable groups—such as the elderly, disabled, or those without smartphones—may face digital exclusion, prompting calls for paper-based alternatives.
• Data and privacy: If you obtain it, data is encrypted and revocable (e.g., if your phone is lost), but refusal avoids any central database risks like cyberattacks.

That sounds like the kind of reply you’d get from Starmer if he answered the phone himself…jibber jabber.

I don’t have a smartphone. It’s becoming problematic now, but the thing is I don’t want one.

neither do i and would not pay for one or any costs that surround them. never send texts and make one single phone call every fortnight. surely there are plenty of others who have them but do not really need them. its like paying for driving lessons and passing your test when you do not intend to drive after it and buy a car to sit unused in the garage. anyone who did that would be certified.

I actually have one, but our lass pays for them ….I only use the phone and camera…the rest is of no interest to me whatsoever..in fact it spends it’s time on the window sill.
